Employer Nomination Scheme Visa – FAQ

Australian firms can sponsor highly talented professionals to live and work there under permanent or temporary work visas. A skilled job in Australia must be offered and accepted for Employer Nomination Scheme Visa. To be able to fill that post, a skilled worker must have all the necessary credentials and professional experience.

Permanent residency permits for skilled employees are called Employer Nomination Scheme subclass 186 visas. Both people living outside of Australia and those currently working and residing in Australia as temporary residents are eligible to apply for this scheme. A skilled individual must have a nomination by an Australian company to qualify for this visa.

Who can file a visa subclass 186 application?

The Temporary Residence Transition (TRT) Stream and the Direct Entry (DE) Stream are the two streams available for the visa subclass 186. The requirements vary for each stream.

A person must possess a subclass 457 visa, a subclass 482 visa, or a bridging visa issued in conjunction with one of these subclasses to apply in the TRT stream.

The applicant can be inside or outside Australia and apply for the Direct Entry stream.

It is for employers who are party to a labour agreement. The candidate must be nominated by the employer and have an occupation deemed ‘skilled’ and on the skilled occupation list. It allows him to live and work in Australia permanently.

When can an applicant submit the nomination and visa applications?

It is best to file the nomination section first. After doing that, one can submit a visa subclass 186 application. The applicant must submit both applications at the same time. If the nomination has already been made, he has six months to file a visa application.

What happens if the applicant submits false information on his visa application?

Applicants who make mistakes while lodging the Employer Nomination Scheme Visa 186 application form can easily and quickly fix all of their errors. Just before submission, this should be completed. However, they must contact the Immigration Department if they discover the error after submitting their application.

Giving false information can have serious consequences, especially when the documents are “BOGUS” or the information is blatantly false. This circumstance may result in visa delays, or the Immigration Department may reject the application.

What are the 186 visa conditions attached to it?

A person can not establish a de facto relationship or marriage between applying for a visa and travelling to Australia. The department can revoke the visa subclass 186 If an applicant fails to inform the immigration office about a planned marriage.

If he violates the 186 visa conditions, is found guilty of a crime, or disturbs the peace in Australian communities, he may be deported.
